Baldwin’s Attorney Speaks Out Against Charges in Deadly Shooting

It was a shocking turn of events when Alec Baldwin, the Hollywood actor was charged in connection with a fatal shooting on the set of his latest film, “Rust.” But now, Baldwin’s lawyer is speaking out against the charges, calling them a “terrible miscarriage of justice.” Known for his roles in films such as “The Departed” and “30 Rock,” Baldwin was simply trying to protect himself and others on the set when the incident occurred according to the lawyer.

On Thursday, attorney Luke Nikas told Insider: This decision distorts Halyna Hutchins’ tragic death and represents a terrible miscarriage of justice. Mr. Baldwin had no reason to believe there was a live bullet in the gun – or anywhere on the movie set,” Nikas said.

Nikas continued, “We will fight these charges, and we will win.” On Thursday morning, prosecutors in Santa Fe revealed that Baldwin will be charged with two counts of involuntary manslaughter for the October 21, 2021 shooting death of cinematographer Halyna Hutchins on the set of the independent Western film.

The incident in question occurred on the set of “Rust,” a gritty crime film that Baldwin was both starring in and producing. According to witnesses, a film crew member became increasingly erratic and aggressive, brandishing a weapon and threatening to harm others. Baldwin, on set at the time, stepped in to intervene, ultimately resulting in the shooting.

The crew member, Halyna, was pronounced dead at the scene. Baldwin was not injured and was taken into police custody.

The district attorney said, “she believed “Rust” had a “really fast and loose set,” saying there was a lack of safety standards and “live rounds on set – they were mixed in with regular dummy rounds. Nobody was checking those or at least they weren’t checking them consistently, And then they somehow got loaded into a gun, handed off to Alec Baldwin; he didn’t check it, he didn’t do any of the things that he was supposed to do to make sure that he was safe or that anyone around him was safe. And then he pointed the gun at Halyna Hutchins and he pulled the trigger.”

The chief medical investigator of New Mexico signed off the official report of the postmortem examination into Hutchins’ death. It states that he died from a “gunshot wound of the chest” due to an “accident.”

“Review of available law enforcement reports showed no compelling demonstration that the firearm was intentionally loaded with live ammunition on set. Based on all available information, including the absence of obvious intent to cause harm or death, the manner of death is best classified as an accident,” the report concluded.

According to the results of the forensics report, the FBI could not fire the weapon during regular operation tests without first pressing the trigger while it was cocked. The pistol finally malfunctioned during testing when internal components cracked and triggered the rifle while still in the cocked position. There has been a flurry of accusations of carelessness and pointing of fingers since the incident.

Baldwin blamed Gutierrez Reed, the film’s armorer and props assistant, and assistant director Dave Halls, who gave Reed the rifle, in an interview with CNN in August. Halls pled guilty to “the charge of careless use of a dangerous weapon,” according to a statement released by the district attorney’s office on Thursday.

It’s a case that has gripped the nation and has people talking about the responsibility of those in positions of power and the line between self-defense and manslaughter.
